1. Definitions
- “Operator” means Jakub Kobík, who owns and operates the Website.
- “User” means any natural or legal person who visits or uses the Website (for example, by adding a server or posting a comment).
- “Server” means a TeamSpeak 3 server added by a User to the list on the Website.
- “TIP status” means a paid feature that highlights a Server and provides additional benefits as described on the Website at the time of purchase.
2. Nature and availability of services
The Website mainly provides a public list of TeamSpeak 3 servers and allows Users to add and manage Server entries and comments. The Operator does not guarantee uninterrupted availability, error‑free operation or permanent functionality of any specific feature.
The Operator may, at any time and without prior notice, modify or discontinue any part of the Website or its services, including paid features. The User has no legal right to the provision of any particular feature free of charge or for a fee.
3. Adding TeamSpeak 3 servers
A Server may only be added if the User is the owner of the Server or is otherwise authorized to manage it. By adding a Server, the User confirms that they are authorized to do so and that all information about the Server is accurate and up‑to‑date.
The Operator does not verify ownership or licensing rights to the Servers and is not liable for any infringement of third‑party rights. The User understands that all information about the Server (including IP address, name and description) becomes publicly available and may be used by third parties (for example via APIs or search engines).
It is prohibited to duplicate the same TeamSpeak 3 Server in the list by adding multiple entries that point to the same physical or virtual host (for example via different addresses, IP/port combinations, aliases or domains). Duplicate entries may be merged or removed without notice, and the Operator reserves the right to impose sanctions, including removing the Server, revoking TIP status, or blocking the account.
4. Editing and removal of servers
The User may request that a Server be edited or removed from the list, usually by proving ownership of the Server (for example via the TS3 server itself or via the e‑mail address used when adding the Server). The Operator may request additional information to verify ownership.
The Operator reserves the right to remove or edit any Server at any time and without giving reasons (for example due to inappropriate content, technical errors, non‑functionality or violation of these Terms). The User is not entitled to any compensation or refund of payments for TIP status solely because a Server was removed, unless expressly agreed otherwise.
5. Comments and user content
Users may post comments related to Servers where this feature is available. When posting a comment, you may be required to provide a name and e‑mail address; the IP address of the commenting device is also recorded.
The User is fully responsible for all content they submit and agrees that comments will not:
- infringe any third‑party rights (e.g. copyrights, trademarks, personality rights),
- contain illegal, offensive, hateful, discriminatory, spam or otherwise inappropriate content,
- contain malicious code or links to harmful content.
The Operator may edit or delete any comment without prior notice, especially if it appears to violate these Terms or applicable law.
6. TIP status and paid services
For selected Servers, TIP status may be purchased, which highlights the Server and moves it to a higher position in the server list. TIP status may be purchased by anyone, not only the Server's owner - the Operator does not verify the purchaser's relationship to the Server. The exact scope of benefits and the price are always described in the current offer on the Website (the "Get TIP status" page for the given Server) or communicated by the Operator. TIP status is provided for the period specified at the time of order; if the Server already has active TIP status, a new payment extends its validity.
Payment for TIP status is accepted via PayPal (TIP status is activated automatically immediately after the payment is successfully received and verified) or by bank transfer according to the details listed on the Payments page - in that case the Operator activates TIP status manually after receiving and verifying the payment, usually within a few business days. The Operator is not responsible for delays or failures caused by the bank or the payment provider (PayPal).
TIP status may only be purchased as a private individual, not on behalf of a company. The purchaser must provide their true name, billing address (street, city, postal code, country) and e-mail address; this information is used solely to issue the invoice/receipt for the payment and to send confirmation, see the Privacy Policy. The Operator is not a registered VAT payer, so the price shown for TIP status is final; when paying via PayPal, an additional transaction fee may be charged by PayPal.
The User acknowledges that TIP status does not guarantee any specific number of visitors or clients for the Server, but only the technical highlighting and higher list position described. Payments for TIP status are refunded only if the Operator fails to activate TIP status at all, or as otherwise expressly agreed.
7. User obligations
The User agrees in particular:
- not to use the Website in violation of applicable law, good morals or these Terms,
- not to interfere with the technical operation of the Website and not to attempt to bypass security measures or overload the servers (e.g. by scraping, DDoS, automated queries),
- not to misuse information displayed on the Website (such as Server IP addresses) for attacks or other harmful activities.
The User shall be liable for any damage caused to the Operator or third parties as a result of breaching these Terms or applicable laws.
8. Liability and disclaimers
The Website and its content are provided “as is” without any warranties regarding completeness, accuracy, uninterrupted availability or error‑free operation. In particular, the Operator is not responsible for the content or availability of individual TeamSpeak 3 servers listed on the Website, nor for any damage arising in connection with the use of the Website, listed Servers or third‑party services (such as Google, Cloudflare, PayPal), to the extent permitted by law.
Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.
9. Privacy and cookies
The processing of personal data is governed by a separate “Privacy Policy” document available on the Website, which forms an integral part of these Terms. Processing includes, in particular, IP addresses, e‑mail addresses, names in comments and technical data collected by Google and Cloudflare services.
By using the Website, you acknowledge that it uses strictly necessary cookies to ensure basic functionality and security, and - only with your consent given in the cookie banner - cookies used to measure traffic (Google Analytics) and display advertising (Google AdSense). You can withdraw or change your consent at any time in the cookie settings available in the Website footer.
10. Intellectual property
The content of the Website (including texts, logo, graphics, code, server database) is protected by copyright and other intellectual property rights of the Operator or third parties. The User may use the Website only within normal use; any bulk downloading, redistribution or commercial use of the content without the Operator’s consent is prohibited.
TeamSpeak and TeamSpeak 3 are trademarks or registered trademarks of their respective owners. The Website is not an official service of TeamSpeak Systems GmbH and is not otherwise formally affiliated with it.
11. Changes to the Terms
The Operator may modify these Terms at any time. The amended version will be published on the Website and will become effective on the date of publication, unless a later effective date is specified.
By continuing to use the Website after the new version becomes effective, you agree to the updated Terms. If you do not agree, you must stop using the Website.
12. Governing law and dispute resolution
These Terms shall be governed by the laws of the Czech Republic. Any disputes arising out of or in connection with the use of the Website shall be submitted to the competent courts of the Czech Republic, unless mandatory law provides otherwise.
